Kendra Roberson utilizes nearly two decades of experience to design and implement health and welfare plans, retirement plans, executive compensation agreements and equity compensation plans. Kendra has deep knowledge of health and welfare plan compliance issues and provides creative solutions to implementing increasing regulations affecting those plans. Kendra has represented public companies, tax-exempt organizations universities and governments in these areas. She has experience representing clients before the Internal Revenue Service, Department of Labor and the Pension Benefit Guaranty Corporation.

Experience

Kendra has provided critical advice to Fortune 500 companies on benefits and executive compensation matters including:

  • Advised a Fortune 500 company in the settlement of $1.7 billion in pension obligations by a purchasing a group annuity contract that covers approximately 70,000 plan participants.
  • Assisted several Fortune 500 companies with responses to DOL investigations, including replies to DOL requests for information related to compliance with the Mental Health Parity and Addiction Equity Act.
  • Disputed a request from the Internal Revenue Service on behalf of a client to make a multimillion dollar employer shared responsibility payment under the Affordable Care Act.
  • Advised clients on offering COVID-19 testing and vaccinations for employees to comply with ERISA.
  • Assisted companies in establishing on-site medical clinics for employees, including during the COVID-19 pandemic.
  • Drafted amendments to retirement and health and welfare plans to reflect recent changes in the law, including SECURE Act, CARES Act, Consolidated Appropriations Act of 2021, and the American Rescue Plan Act.
  • Drafted several Fortune 500 companies’ nonqualified deferred compensation plans for executives and directors.

Summer Conley, Partner with Faegre Drinker Biddle & Reath LLP

Summer Conley is leader of the firm’s benefits and executive compensation group. She guides companies through the complicated legal landscape surrounding employee benefits. She advises on qualified plan, health and welfare and executive compensation issues related to:

  • Retirement plan committee fiduciary responsibilities
  • Internal Revenue Service (IRS) and Department of Labor (DOL) correction procedures
  • Health Insurance Portability and Accountability Act (HIPAA)
  • Consolidated Omnibus Budget Reconciliation Act (COBRA)
  • Section 125
  • Health care reform
  • Alternative plan investments

Summer helps companies comply with HIPAA privacy regulations and health care reform rules, and she assists plan sponsors and fiduciaries in complying with the Employee Retirement Income Security Act (ERISA) and the Internal Revenue Code.

Summer drafts various plan documents, including summary plan descriptions and employee communications, and she counsels clients on establishing, changing and terminating benefits programs and on entering into benefits services agreements. She assists pension plan clients with the process of reviewing alternative investment fund materials and negotiating related side letters.
